Roust Trading and the Issuer, however, have agreed to forbear from taking any action or commencing any proceeding to enforce rights or remedies arising out of or relating to such notice through April 30, 2013.

Purpose of Transaction.

The Reporting Persons hereby add the following disclosure to this Item 4:

On April 26, 2013, the Issuer, Roust Trading and RAG entered into an Amended and Restated Securities Purchase Agreement (the “Amended and Restated RTL Investment Agreement”) in order to modify certain terms of the RTL Investment Agreement to reflect the Amended Plan.

The foregoing disclosure is qualified in its entirety by reference to the full text of the Amended and Restated RTL Investment Agreement, a copy of which is attached hereto as Exhibit 99.46 and is incorporated herein by reference.

The Reporting Persons may in the future engage in conversations with the Issuer, other stockholders and/or other security holders with respect to this matter or other transactions or changes in governance, management or the Board of Directors of the Issuer and may make additional proposals that may include proposing, considering or undertaking one or more of the actions set forth in subsections (a) through (j) of Schedule 13D. The Reporting Persons may also seek to increase their ownership of the Issuer’s securities beyond that which they have on the date of this filing.
